These Terms govern your access to and use of clearvital.world, including informational content about home fitness coaching operated by Clearvital from Berlin, Germany. Separate contractual instruments apply to paid coaching when you and we sign them.

Eligibility and capacity

The website is directed at users who can form legally binding agreements in their jurisdiction. If you access the site on behalf of an organisation, you represent that you have authority to bind it to these Terms for browsing and inquiry purposes. Age restrictions for particular coaching products are laid out in the applicable product description and contract.

Article II

Informational content boundary

Articles, layout copy, and illustrative diagrams describe coaching approaches without guaranteeing fitness or health outcomes. The site does not diagnose, treat, or monitor diseases. When in doubt about readiness for exercise, consult licensed professionals who know your history. Nothing on these pages substitutes for emergency services.

We may reference research summaries at a high level; citations, if provided, are for orientation and can become outdated as science evolves.

Article III

Accounts and credentials

Future client portals, if launched, will require unique credentials. You must safeguard passwords, limit shared use, and notify us promptly of suspected compromise. We may suspend access when automated abuse signals exceed thresholds while investigations proceed.

Acceptable use

Do not attempt to probe, disrupt, or bypass security controls without written authorisation.
Do not overload infrastructure with automated requests unrelated to ordinary browsing.
Do not upload malware, illegal material, or content infringing third-party rights through any interactive feature.
Do not harvest personal data of other visitors from publicly visible areas for unsolicited commercial messaging.
Impersonation of our brand, staff, or partners is prohibited.

Violations may lead to technical blocking, preservation of evidence where lawful, and cooperation with authorities. Civil remedies remain reserved.

Article V

Intellectual property

Unpublished drafts, design tokens, typography pairings, custom SVG illustrations, and training templates are protected by copyright, trade dress where applicable, and contractual confidentiality when delivered to paying clients. You receive a limited, revocable licence to view the public website for personal, non-commercial reference unless another agreement expands rights.

Remix icon fonts and Google fonts remain subject to their upstream licences. Trademarks referenced descriptively are owned by their respective holders.

Disclaimer of warranties

We do not warrant that files are free of harmful code; keep antivirus tools current.

Article VIII

Limitation of liability

To the fullest extent permitted by German and EU consumer law, we are liable without limitation for intent and gross negligence, for injury to life, body, or health, under guaranteed characteristics, and under the Product Liability Act when applicable. For ordinary negligence, liability arises only for breach of essential contractual duties and is limited to foreseeable, typical loss unless a narrowly defined carve-out applies.

Liability for slightly negligent breaches of non-material duties is excluded subject to the preceding sentence. These caps do not shift burden of proof to your disadvantage when rules prohibit such clauses for consumers.

Article IX

Indemnity for misuse

If you are a business user and third parties sue us because of your unlawful site misuse or content you uploaded, you agree to indemnify us for reasonable defence costs and final judgments attributable to that conduct, except where our own intentional misconduct predominates.

Consumers are not asked to indemnify us beyond what mandatory law allows.

Article X

Governing law and venue

These browse Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules that would refer elsewhere. If you are a consumer with habitual residence in another EU country, non-waivable protections of that country persist.

Venue for merchants follows statutory rules; consumer venue privileges remain intact. Online dispute links appear in the Impressum without implying obligation to use particular boards.

Article XI

Severability and assignment

Should a clause be invalid, the remainder stays enforceable; parties substitute a valid approximation matching commercial intent where possible. We may assign website operations in connection with mergers or asset transfers if your rights are not materially downgraded.
